Fisique Fitness – Terms and Conditions

1. Introduction

1.1 These Terms and Conditions (“Terms”) govern your use of the Fisique Fitness website (“Website”), mobile application (“App”), and your membership at the Fisique Fitness center (“Center”), operated by Surya Narayana Enterprises LLP (“Company”). By accessing the Website, App, or using the Center, you agree to be bound by these Terms.

1.2 The Company reserves the right to modify these Terms at any time, and will notify you of any material changes by email or through the Website/App. Your continued use of the Website, App, or Center constitutes acceptance of the updated Terms.

2. Membership

2.1 Eligibility & Registration: Membership is open to individuals who are at least 18 years old and legally capable of entering into contracts. Minors (16-17 years old) may use the Center with parental/guardian consent and supervision.Registration requires accurate and complete information, including a valid government-issued ID.

2.2 Types, Fees, & Payments: The Company offers various membership options (e.g., monthly, quarterly, annual) with varying fees and benefits. Details are available on the Website/App/Center. Accepted payment methods include cash,credit/debit cards, net banking, UPI, and other online options as specified. Membership fees are non-transferable.

2.3 Renewal & Cancellation: Memberships automatically renew unless cancelled before the next billing cycle.Cancellation requires written notice (email/letter) within the specified period before renewal. Refunds, if applicable, are subject to the Company’s discretion and may be pro-rated.

3. Use of Facilities & Services

3.1 Hours & Access: Center hours are posted on the Website/App/Center and may change seasonally or for special events.Members must present their membership card/ID for entry.

3.2 Rules & Etiquette: Members must adhere to posted rules regarding equipment use, attire, hygiene, and conduct towards others. Failure to do so may result in warnings, temporary suspension, or termination of membership.

3.3 Personal Training: Separate fees and terms apply to personal training sessions. Trainers are independent contractors,not Company employees. The Company is not liable for trainer actions or results.

3.4 Classes & Workshops: The Company may offer group classes or workshops, subject to separate registration, fees, and cancellation policies.

3.5 Lockers & Belongings: The Company provides lockers for temporary use only. It is not responsible for lost, stolen, or damaged items.

4. Online Services

4.1 Account: Website/App use may require creating an account. You are responsible for keeping your login credentials confidential and for any activity under your account.

4.2 Content: The Company may offer online workouts, nutrition plans, or other content. This is for informational purposes only and not a substitute for professional advice.

4.3 Online Payments: Online transactions are subject to additional security measures. The Company uses reputable payment processors but is not liable for their errors. Refunds for online purchases follow the same policy as membership cancellations.

5. Liability & Assumption of Risk

5.1 Physical Activity: Members acknowledge inherent risks in exercise and using the Center’s equipment. The Company is not liable for injuries unless caused by gross negligence.

5.2 Waiver: By using the Center or participating in its activities, members waive their right to sue the Company, its staff,or trainers for any injury, loss, or damage, unless caused by gross negligence.

6. Intellectual Property & Content

6.1 Ownership: All content on the Website/App (text, images, videos, etc.) belongs to the Company and is protected by copyright. Members may not reproduce or distribute it without permission.

6.2 User-Generated Content: If you post reviews or comments, you grant the Company a non-exclusive license to use it for promotional purposes.

7. Privacy

7.1 Data Collection & Use: The Company collects personal information for membership management, communication,and service improvement. It complies with applicable data protection laws.

7.2 Disclosure: Your information may be shared with third parties only for payment processing, legal compliance, or with your explicit consent.

8. Termination

8.1 By Company: The Company may terminate your membership for breach of these Terms, non-payment, or conduct detrimental to the Center’s environment.

8.2 By Member: You may cancel your membership as per the cancellation policy.

9. Miscellaneous

9.1 Governing Law: These Terms are governed by the laws of Telangana, India.

9.2 Disputes: Any disputes will be attempted to be resolved amicably. If unresolved, they shall be subject to the exclusive jurisdiction of the courts in Telangana, India.

9.3 Severability: If any provision of these Terms is deemed invalid, the rest remain in force.

9.4 Entire Agreement: These Terms constitute the entire agreement between you and the Company regarding your membership and use of its services,superseding any prior agreements or understandings, whether oral or written.

9.5 Amendments: The Company reserves the right to amend these Terms at any time. Any amendments will be posted on the Website/App and will become effective immediately upon posting. Your continued use of the Website/App/Center after the posting of any amendments constitutes acceptance of those amendments.

9.6 Notices: Any notices or other communications required or permitted to be given under these Terms shall be in writing and shall be deemed to have been duly given when delivered personally, sent by registered mail, or sent by email to the address provided by you during registration.

9.7 Waiver: No waiver by the Company of any breach of these Terms shall constitute a waiver of any other breach or of any subsequent breach.
